This website is operated by Feral Faebles. Throughout this site, the terms "we," "us," and "our" refer to Feral Faebles. Feral Faebles offers this website, including all information, tools, and services available from this site, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us — including commissioning custom artwork — you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service," "Terms"), including those additional terms and conditions and policies referenced herein or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, customers, and commissioners.

Please read these Terms of Service carefully before accessing or using our website or commissioning artwork. By doing so, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not access the website, place an order, or commission work from us.

Any new features or tools added to the current store are also subject to these Terms of Service. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates to our website. It is your responsibility to check this page periodically for changes. Your continued use of the site or continued engagement of our commission services following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on a third-party e-commerce platform (such as Shopify or Etsy), which provides the online infrastructure that allows us to sell our products and services to you.

SECTION 1 — ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your jurisdiction and have given us consent to allow any minor dependents to use this site.

You may not use our products or commission services for any illegal or unauthorized purpose, nor may you, in using the Service, violate any laws in your jurisdiction, including copyright laws.

You must not transmit any worms, viruses, or code of a destructive nature.

A breach or violation of any of these Terms will result in immediate termination of your access to our Services.

SECTION 2 — GENERAL CONDITIONS

We reserve the right to refuse service, and to decline or cancel any commission, to anyone for any reason at any time.

You understand that your content (not including payment information) may be transferred unencrypted and involve (a) transmissions over various networks, and (b) changes to conform to technical requirements of connecting networks or devices. Payment information is always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, or any artwork obtained through the Service beyond the usage rights expressly granted to you under Section 5 below, without our express written permission.

Headings used in this agreement are included for convenience only and do not limit or otherwise affect these Terms.

SECTION 3 — ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is inaccurate, incomplete, or outdated. Material on this site is provided for general information only and should not be relied upon as the sole basis for decisions. Any reliance on material on this site is at your own risk.

We reserve the right to modify the contents of this site at any time, but have no obligation to update information. You agree it is your responsibility to monitor changes to our site.

SECTION 4 — MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products and commissions are subject to change without notice, except that the price quoted and agreed to for an in-progress commission will not change once full payment has been received and the commission accepted, absent a change in scope requested by you.

We reserve the right at any time to modify or discontinue the Service, or any part of it, without notice.

We are not liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

SECTION 5 — PRODUCTS, SERVICES, AND CUSTOM COMMISSIONS

Certain products or services may be available exclusively online and may have limited quantities. We have made every effort to display our products and past commission work as accurately as possible, but we cannot guarantee that your monitor's display of any color will be perfectly accurate.

We reserve the right, but are not obligated, to limit sales or commission acceptance to any person, region, or jurisdiction, on a case-by-case basis. We reserve the right to discontinue any product or commission type at any time. We do not warrant that any product, commission, or service will meet your expectations in every subjective respect (for example, artistic interpretation), though we will work in good faith toward the agreed concept.

Feral Faebles offers two categories of custom commission work, each with its own process outlined below. Specific pricing, quoted turnaround time, and any project-specific terms will be confirmed with you in writing (via invoice, order confirmation, or direct message) before work begins, and that written confirmation is incorporated into these Terms for your specific order.

A. Custom Binder Commissions

  • Payment: Full payment is required upfront before work begins. No partial deposit option is currently offered for binder commissions.
  • Revisions: One (1) round of revisions is included at the concept/sketch stage before final production begins. Additional revision rounds, or requests for changes after final approval, may incur an additional charge.
  • Cancellations: Once work has begun on your binder commission, cancellation requests are handled on a case-by-case basis at our sole discretion. Refunds, if any, are not guaranteed and will account for work already completed, materials used, and time invested.
  • Usage rights: A custom binder commission is a one-of-a-kind physical item made for you. Ownership of the physical item transfers to you upon completion and payment. However, the underlying artwork and design remain the intellectual property of Feral Faebles. You may keep and use your physical binder personally, but you may not photograph, scan, reproduce, mass-produce, sell, or commercially distribute copies of the design or artwork without our separate written permission.
  • Approval: Production on the final binder will not begin until you approve the sketch/concept stage in writing.

B. Other Custom Commissions

  • Payment: Full payment is required upfront before work begins.
  • Revisions: Two (2) rounds of revisions are included before final delivery. Additional revisions beyond this, or significant changes requested after final approval, may incur an additional charge.
  • Cancellations: Once work has begun, cancellation requests are handled on a case-by-case basis at our sole discretion. Refunds, if any, are not guaranteed and will account for work already completed.
  • Usage rights: Usage rights for non-binder commissions vary by project and will be specified in writing at the time your commission is confirmed (in your invoice or order confirmation). Unless otherwise agreed in writing, the default is personal use only — you may display and personally use the finished piece, and Feral Faebles retains reproduction, print, and commercial rights to the artwork, including the right to feature it in our portfolio or for sale as prints.

General Commission Policies

  • We reserve the right to decline any commission request, including but not limited to requests involving: hate symbolism, or subject matter we are not comfortable producing.
  • Turnaround times communicated to you are estimates, not guarantees, and may be affected by order volume, complexity, or delayed responses from you during the approval process.
  • Unless you request otherwise in writing, we reserve the right to photograph, share, and post progress images and the finished commission in our portfolio and on social media / shop platforms.
  • Delays caused by slow customer response to approval requests may extend your project's place in the queue.

SECTION 6 — ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order or commission request. We may, in our sole discretion, limit or cancel orders per person, household, or account, including orders that appear to use the same payment method or shipping/billing address. If we change or cancel an order, we may attempt to notify you using the contact information provided at the time of order.

You agree to provide current, complete, and accurate purchase and account information for all orders and commissions, and to promptly update your information, including your email address and payment details, so that we can complete your transaction and contact you as needed.

SECTION 7 — OPTIONAL TOOLS

We may provide access to third-party tools over which we neither monitor nor have any control. Such tools are provided "as is" and "as available" without warranties of any kind, and we have no liability arising from your use of them. Use of optional third-party tools is at your own risk, and you should review the relevant third party's own terms before use.

SECTION 8 — THIRD-PARTY LINKS

Certain content, products, and services available through our Service may include materials from third parties. Third-party links on this site may direct you to websites not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of, and do not warrant or bear liability for, any third-party materials, products, services, or websites. Please review the third party's own policies before engaging in any transaction with them.

SECTION 9 — USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If you send us creative ideas, suggestions, proposals, reference images, or other materials ("comments"), whether requested or unrequested, you agree that we may use them without restriction or compensation to you, except that reference photos you provide specifically for your own commission will only be used for that purpose unless you agree otherwise.

You agree that your comments and submissions will not violate any third party's rights, including copyright, and will not contain unlawful, abusive, or obscene material. You are solely responsible for the content and accuracy of anything you submit to us.

SECTION 10 — PERSONAL INFORMATION

Your submission of personal information through the store is governed by our Privacy Policy.

SECTION 11 — ERRORS, INACCURACIES AND OMISSIONS

Occasionally our site or Service may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, and availability. We reserve the right to correct these and to change or update information, or cancel orders, at any time without prior notice, including after an order has been submitted.

SECTION 12 — PROHIBITED USES

In addition to other prohibitions in these Terms, you are prohibited from using the site, our Service, or requesting a commission: (a) for any unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to violate any regulations, rules, or laws; (d) to infringe upon our intellectual property rights or those of others; (e) to harass, abuse, or discriminate against any person; (f) to submit false or misleading information; (g) to upload viruses or malicious code; (h) to collect or track others' personal information without consent; (i) to spam, phish, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service. We reserve the right to terminate your use of the Service for violating any of these prohibited uses.

SECTION 13 — DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee that your use of our Service will be uninterrupted, timely, secure, or error-free, or that any results obtained from use of the Service will be accurate or reliable.

You agree that we may remove or modify the Service, or decline or discontinue commission work, at any time without notice.

The Service and all products, commissions, and services delivered through it are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no case shall Feral Faebles, its owner(s), agents, or contractors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the Service or any product or commission procured through it, even if advised of the possibility of such damages. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law in such jurisdictions.

SECTION 14 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Feral Faebles and its owner(s), agents, and contractors from any claim or demand, including reasonable attorneys' fees, made by any third party arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

SECTION 15 — SEVERABILITY

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed from these Terms, without affecting the validity of the remaining provisions.

SECTION 16 — TERMINATION

Obligations and liabilities incurred prior to termination shall survive termination of this agreement. These Terms are effective until terminated by either you or us. You may terminate by ceasing to use our site and services. If, in our sole judgment, you fail to comply with any term of these Terms of Service, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.

SECTION 17 — ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. These Terms of Service, together with any policies posted on our site and any written commission confirmation specific to your order, constitute the entire agreement between you and us and supersede any prior agreements or communications, whether oral or written.

These Terms of Service, and any separate agreements under which we provide you Services, shall be governed by and construed in accordance with the laws of [YOUR STATE], United States.

SECTION 21 — AGREEMENT WHEN ORDERING

Upon placing an order or commissioning artwork, you agree that: (a) any loss of mail in transit will not be refunded unless you purchased shipping insurance; (b) you accept responsibility for any import fees or duties applicable in your country; (c) the shipping address you provide is correct, and you accept responsibility, including possible loss of the order, if it is not; and (d) you have read and understood these Terms and our commission policies before placing an order.
